The Stop Online Piracy Act (SOPA), also known as House Bill 3261 or H.R. 3261, is a bill that was introduced in the United States House of Representatives on October 26, 2011, by House Judiciary Committee Chair Representative Lamar S. Smith (R-TX) and a bipartisan group of 12 initial co-sponsors. The bill, if made law, would expand the ability of U.S. law enforcement and copyright holders to fight online trafficking in copyrighted intellectual property and counterfeit goods.[2] Presented to the House Judiciary Committee, it builds on the similar PRO-IP Act of 2008 and the corresponding Senate bill, the PROTECT IP Act.[3]<br />
The originally proposed bill would allow the U.S. Department of Justice, as well as copyright holders, to seek court orders against websites accused of enabling or facilitating copyright infringement. Depending on who makes the request, the court order could include barring online advertising networks and payment facilitators from doing business with the allegedly infringing website, barring search engines from linking to such sites, and requiring Internet service providers to block access to such sites. The bill would make unauthorized streaming of copyrighted content a crime, with a maximum penalty of five years in prison for ten such infringements within six months. The bill also gives immunity to Internet services that voluntarily take action against websites dedicated to infringement, while making liable for damages any copyright holder who knowingly misrepresents that a website is dedicated to infringement.[4]<br />
Proponents of the bill say it protects the intellectual property market and corresponding industry, jobs and revenue, and is necessary to bolster enforcement of copyright laws, especially against foreign websites.[5] They cite examples such as Google's $500 million settlement with the Department of Justice for its role in a scheme to target U.S. consumers with ads to illegally import prescription drugs from Canadian pharmacies.[6]<br />
Opponents say that it violates the First Amendment,[7] is Internet censorship,[8] will cripple the Internet,[9] and will threaten whistle-blowing and other free speech actions.[7][10] Opponents have initiated a number of protest actions, including petition drives, boycotts of companies that support the legislation, and planned service blackouts by English Wikipedia and major Internet companies scheduled to coincide with the next Congressional hearing on the matter.<br />
The House Judiciary Committee held hearings on November 16 and December 15, 2011. The Committee was scheduled to continue debate in January 2012,[11] but on January 17 Chairman Smith said that "[d]ue to the Republican and Democratic retreats taking place over the next two weeks, markup of the Stop Online Piracy Act is expected to resume in February."[12]</div></div><br />

		<title>TouchPad longevity gets a boost from Android/Ub...</title>

		<description><![CDATA[HP put the brakes on its ambitious webOS strategy earlier this month after announcing plans to unload its entire consumer hardware business. Although the platform could potentially live on through future licensees, HP doesn't plan to deliver new products with the software. To unload the current stock of TouchPad tablets, HP kicked off a fire sale and put the $499 device up for grabs at a generous $99. The sell-off was met with huge consumer demand, prompting HP to light up production for one more run.<br />
<br />
The big unanswered question, however, is what will happen when HP eventually sheds its commitment to the operating system. If licensees doesn't take over stewardship of webOS and the platform stagnates, those Touchpads aren't going to be particularly useful. Fortunately, the enthusiast community is coming up with some technical solutions and finding ways to bring additional third-party software and alternate operating systems to the TouchPad.<br />
<br />
One option is an Ubuntu chroot environment, which makes it possible for users to get conventional desktop Linux applications running on HP's device in an X11 server. Linux software that can be compiled to run on ARM CPUs will work on the TouchPad. In a YouTube demo video, you can see LXDE, Chromium, and Abiword running on the TouchPad. Installation instructions are available from the webOS Roundup forums.<br />
<br />
Android on the TouchPad is another intriguing option that's starting to come together. There is already an experimental port of CyanogenMod that can run on the device. It's still not mature or stable yet and it's not a tablet-optimized user experience because it's based on Gingerbread source code (due to the lack of Honeycomb source availability). We could see much better Android builds emerge for the TouchPad after Android's Ice Cream Sandwich release, which will hopefully come with source code.<br />
<br />
Oddly enough, a small handful of consumers who purchased TouchPads during the fire sale received developer hardware units with Android preinstalled. These are believed to have originated from Qualcomm's internal development labs and were clearly not intended for distribution to end users. It's unclear how these prototypes ended up in the sales channel.<br />
<br />
One of the recipients filmed a video, which you can see at Geek.com, and offered to rip a system image for the modding community—which could help accelerate efforts to enable full hardware support for the TouchPad in community Android builds.<br />
<br />
Of course, webOS could still have some life left in it. If the platform gets licensed and the third-party developer community sticks around, there might not be much of a need for alternate software. It looks like it could be a nice hardware environment for prototyping jQuery Mobile applications or any number of other useful tasks. The availability of alternative platforms is a nice safety net, however, that will prevent the device from turning into a glorified photo frame in the event that official support completely evaporates.<br />

		<title>Razer unveils unique gaming laptop</title>

		<description><![CDATA[<p class="MsoNoSpacing">Razer came by our offices the other day to show us their first foray into the laptop market, which could have been accomplished in a simple press release, but they’re obviously proud of what they’re dubbing the Razer Blade, and from the look of it, they probably have a reason to be. <p class="MsoNoSpacing">The main claim for the Blade is that it’s “the world’s first true gaming laptop.” Bold claim, we know. They explained to us what it means: the power of a monster laptop like the ones Alienware produces, but without the excessive bulk, which makes typical gaming laptops not conveniently portable. The Blade has a 17-inch screen, making it basically the same size as<br />
a MacBook Pro as far as width and length, but it’s even thinner than the Mac at 0.88 inches. They’ve also managed to shrink the power supply to about half that you’d find in an Alienware, adding to the overall portability.</p><br />

<p class="MsoNoSpacing">The feature that makes the Blade unique, though, is the Switchblade interface. On the right side of the keyboard is a massive touchpad/screen with mutlitouch capability and gestures for control, and the pad also serves as a second screen. Some of the uses mentioned were being able to train the screen at a different point of the map during a match of League of<br />
Legends so you can watch two places at once, or running YouTube on it so you have a video walkthrough handy while playing a game on the big screen. We don’t know how well the touchpad will work for actually controlling a game, say in an FPS, but the huge size of it could make it a viable option, at least in single-player where the pressure of competition isn’t present. Above the pad are ten keys with their own displays, meaning you can program commands into them and also have backlit icons from the actual game within each key. Certain games will have official support for icons and commands, but users can also generate their own templates and share them with others.</p><br />

<p class="MsoNoSpacing">The whole package is damn sexy to look at, but unless we get a chance to actually play some games on it, we don’t know yet how it all handles. It may not be totally competitive with a top-of-the-line desktop, but it’s close. Here are the specs:</p><br />

<p class="MsoNoSpacing">Of course, none of this will come cheap. Hold onto your wallets – the Blade clocks in at a retail price of $2799.99. While that is nothing to sneeze at, on paper it’s much more powerful and thinner than a MacBook Pro, so it’s in theory competitively priced. We’re also curious to see how the Switchblade interface works, since it’s something we haven’t seen in other laptops. We’ll find out if the Blade can fulfill all of its promises sometime later this year.</p><p class="MsoNoSpacing">]]></description>

		<title>Steve Jobs RESIGNS from Apple!</title>

		<description><![CDATA[Steve Jobs has resigned as chief executive officer of Apple (AAPL). The company has promoted chief operating officer Tim Cook to the position of CEO and said that Cook will join the company's board of directors. Jobs will become Apple's chairman.<br />

Apple board member Art Levinson, chairman of Genentech, issued the following statement on behalf of the Apple board:<br />

We have no additional details yet on why Jobs is leaving, although the spot assumption is that it's related to the pancreatic cancer for which he received a liver transplant in 2009. The fact that Jobs is taking over as board chairman, rather than resigning that seat too, would seem to indicate that his condition is serious but not imminently debilitating.<br />
<br />
Apple shares today traded up $2.58 to close at $376.18 per share. As of 6:53pm, it already had lost $22.18 per share, or 5.9% of its value.<br />

		<title><![CDATA[HP's big mistake: Killing WebOS]]></title>

		<description><![CDATA[So have you heard the news? HP is killing off it's WebOS Division that cost them $1million large bucks.. Their also spinning its PC buisnes off.<br />

It's kind of a tragedy to see the TouchPad receive a cold shoulder by consumers, but in all reality it's really HP's own fault. HP could have done alot to actually make the TouchPad an amazing device. The Operating System, called WebOS, is a truly innovative Mobile OS, and was more then ready for consumer's hands long before Android was, and even before Windows Phone 7 was out. all HP had to do is pay some more money, after all, you cannot expect the brand to just thrive without putting money in it.<br />
<br />
So what should HP have done differently? Well i'll tell you what i think HP should really have done below.<br />

<strong class='bbc'>Distribute WebOS</strong><br />
It's that simple. WebOS can still live on if it would just allow for the distribution of WebOS, kind of what Google and Microsoft is doing. It would'nt really be that hard to get HTC, Samsung or other Phone Manufacturers to put the OS on their phones. They could've even got Nokia to jump on board. With the announcement of Google's Motorola Mobility purchase, i believe it would have been even more easier, since some companies are afraid Google will go the "apple route" (building the Software and the Hardware).<br />
<br />
<strong class='bbc'>Advertise & continue to innovate</strong><br />
To my surprise, HP has not really advertised the Pre series phones. I've seen veer ad's but who wants a tiny phone? Im no midget, and alot of people already complain about large fingers on the iPhone's on screen, so why a small phone?<br />
HP made the big mistake of kind of leaving WebOS alone.. They should have offer'd Student's large discounts, offered the phone as a "free" phone on carriers, or even bundled it.. It would've been smart to bundle the TouchPad or Pre3 with an HP Laptop..<br />
"Buy a laptop, get a Tablet! all for $1,000" Now that would be impresive.. It'd be even greater if they would advertise a Bridge service that would allow for you to transfer what you're doing on the tablet to the computer and vice versus just by placing the Tablet on a Touchstone equiped HP Laptop.. Or even the phone..<br />
<br />
HP messed up big time, and now their facing the consequences of poor Management By allowing their PC business to spin off and by killing the WebOS Division.<br />

		<title><![CDATA[Dear Feds: We want more Spectrum, tMobile &#38;...]]></title>

		<description><![CDATA[Apparently AT&T is not satisfied with the proposed acquisition of T-Mobile and its earlier bid to buy a nice hunk of Qualcomm 700MHz licenses. The telco is also filing smaller applications with the Federal Communications Commission for broadband spectrum in the 700MHz zone.<br />
<br />
On Thursday, the FCC disclosed AT&T's bid to transfer two licenses from Knology of Kansas to itself. These are properties in the "beachfront broadband" quality Lower 700MHz B and C block regions.<br />
<br />
The applications say that the extra spectrum will allow AT&T "to increase its system capacity to enhance existing services, better accommodate its overall growth, and facilitate the provision of additional products and services to the public" in the Worcester-Fitchburg-Leominster, Massachusetts and Lawrence, Kansas cell phone market areas.<br />
<br />
The FCC's "preliminary review" of the applications indicates that in Lawrence, AT&T would then hold 55MHz of spectrum below one GHz, and in the Worcester areas possess 61MHz of spectrum below that same ceiling.<br />

This isn't a huge addition to AT&T's portfolio, but it stands out given the company's higher profile T-Mobile and Qualcomm bids. Indeed, the Commission's disclosures note that these spectrum estimates take into account AT&T's pending applications to acquire 12MH of Lower 700MHz D and E Block spectrum from Qualcomm in the Massachusetts market, and six megahertz of Lower 700 MHz D Block licensage in the Kansas market.<br />

AT&T wants Qualcomm's Lower 700MHz D and E block licenses in Boston, Los Angeles, New York, Philadelphia, and San Francisco. Looming over the Qualcomm application is the question of whether the FCC should consider it and the T-Mobile bid's potentially anti-competitive impact in one competitive impact review package. That's what five media reform groups asked the FCC to do in late April.<br />

Both proceedings "should be combined to enable a full and complete competitive analysis," Free Press, Public Knowledge, the Media Access Project, and two other groups urged. Ditto say MetroPCS, Sprint, and Rural Celluluar Association in their own filing.<br />

As you might guess, AT&T isn't crazy about this idea. "A delay in the proceeding also could result in a delay in AT&T’s more efficient use of the spectrum (as early as 2014)—a result inconsistent with the National Broadband Plan's goal of putting spectrum to a more efficient use," the company warns in its statement opposing consolidation.<br />

Besides, the Commission is "fully capable" of considering the impact of Qualcomm acquisition in a separate proceeding, the telco writes. Next comes a sentence that suggests that AT&T considers the Qualcomm application a done deal:<br />

"Indeed, the AT&T/T-Mobile applications assume the consummation of the AT&T/Qualcomm transaction for purposes of the spectrum screen analysis in the Public Interest Statement filed in that proceeding."<br />

The founder of file-sharing company Lime Wire agreed on Thursday to pay $105 million to the Recording Industry Association of America to settle a 5-year-old copyright case. Sure, that's a lot, but consider that the settlement figure is equal to only 7 percent of the $1.4 billion the RIAA sought. </p><p> <br />
This is likely the final chapter for LimeWire, after 10 years in operation. The two sides agreed to settle a year to the day after U.S. District Judge Kimba Wood ruled that Gorton was liable for willful copyright infringement. Later, Wood ordered that the LimeWire peer-to-peer network be shut down. The financial agreement between Gorton and the labels came amid a jury trial to determine how much Gorton would have to pay in damages. </p><p> <br />
For fans of cheap, easy-to-obtain music, a few modest reasons for hope sprung up during the two-week-long damages trial. </p><p> <br />
Edgar Bronfman, CEO of Warner Music Group, one of the four largest record companies, said under oath that he supported the unbundling of music. You might be saying to yourself: "So what?" People have had access to unbundled music for a decade now, thanks to services like iTunes and, yes, LimeWire. All I can tell you is that there are plenty of decision makers at the labels who believe the industry won't recover until consumers are buying albums again. </p><p> <br />
Bundled music, mostly in the form of the CD, was a boon for the recording industry. Instead of selling individual songs, for say $1 each, they sold CDs for $15 that typically came with 12 or 14 songs. Too often though, music buyers would shell out for a CD only to find that two of the tracks were any good. What did the record companies care? Rather than generating $2 for each of those two hit songs--like they do now--the labels pocketed $15. </p><p> <br />
In five years covering digital media, I haven't heard a single high-ranking label executive publicly come out against music bundling--just the opposite. But during questioning by Gorton's lawyer, Joseph Baio, Bronfman said the unbundling of songs is a great opportunity for consumers <i>and</i> record companies. </p><p> <br />
"The truth of the matter is," Bronfman said, "if a consumer goes and spends $25, $30 to buy a couple of albums and that's what they spend each year on music, and from those albums they're getting two, three, four songs that they really like...that may not be a great experience. But if the consumer can spend the same $25 and get 25 songs that they love, that is a fantastic experience."<br />

<b>Spotify's conversion numbers up?</b> <br />
<br /> Baio also asked Bronfman about Warner Music's business relationship with Spotify, the European music service that has unsuccessfully attempted to jump to the United States for nearly two years. Before licensing Spotify, the big record labels want to see the company converting about 15 percent of the users of its free-to-consumer, ad-supported service to the paid-subscription service, music industry sources told me last year. </p><p> <br />
When Baio mentioned that 95 percent of Spotify's users obtain music from the service free of charge, Bronfman corrected him. "It is currently about 85 percent," Bronfman told the court. </p> <br />

In March, Spotify reported 1 million paying subscribers and generated some buzz by claiming the figure represented 15 percent of the users. That didn't sound right because in September, the company reported 10 million users and the 1 million paying users would have equaled 10 percent. But Spotify said it was referring not to total users but to "active" users. </p><p> <br />
Tweaking the numbers that way didn't fool anybody at the labels, according to my industry sources. However, if Bronfman made an issue in court about the higher percentage of paid users, perhaps Spotify's 15 percent number is solid. If it is, it could mean Spotify is generating the kind of revenue the labels want to see before letting the company enter the U.S. market. </p><p> <br />
<b>No reliable piracy data</b> <br />

One other note about the RIAA's case against file sharing: the record companies still can't seem to point to any hard numbers about its impacts. For the days I was in court, which included the opening statements, and testimony from several music industry executives, there was no reliable data to pin specific dollar losses to piracy. The best the RIAA could do was point jurors to the decline in annual music sales for most of the past 10 years and studies from NPD Group, which are based on samples, and claim that all the bad news is because of file sharing. </p><p> <br />
Baio asked Bronfman to compare the damage caused by some of the other factors pressuring the industry besides piracy, such as waning interest in CDs and more competition from video games. </p><p> <br />
"Well, it's hard, I think, to compare, because there is no specific factual evidence," Bronfman said. "But to me, you know, the economic recession...in 2009 probably had some effect on the industry's growth into part of 2010, but Internet peer-to-peer piracy and all that is derived from, that...seems to me to be the majority of the issues that have hurt the industry so badly."<br />

To prove that piracy is harmful, say music industry critics, more evidence is required than someone's gut feeling. </p><br />
